Manslaughter prosecutions of persons connected to overdose deaths, even remotely, are on the increase. The Forensic Autopsy Performance Standards adopted by the National Association of Medical Examiners require a forensic pathologist perform a forensic autopsy when the death is by apparent intoxication by drugs. In other words, no autopsy, no case. Charges reduced from Manslaughter to Wanton Endangerment and from Trafficking to Possession, total sentence of five years probated for five years.
